TERMS AND CONDITIONS FOR SERVICE PROVIDERS

The following General Terms and Conditions (“Terms”) apply to all service providers (“you” or “Service Provider”) who wish to use the mijo app. These terms govern your registration, use, and participation on the mijo platform as a service provider.

By registering and using the mijo app as a service provider, you agree to the following terms and conditions:

  1. SERVICE PROVIDER REGISTRATION AND ACCOUNT**

1.1 Eligibility

To register as a service provider on the mijo app, you must be an individual or an entity legally authorized to offer services under the laws of the Republic of Ghana or your respective country. You must have the requisite licenses, permits, or qualifications necessary to perform the services you offer.

1.2 Account Creation 

To use the mijo app, you are required to create an account by providing accurate and complete information, including your legal name, contact information, and any relevant professional certifications or qualifications. You are responsible for maintaining the confidentiality of your account login details and must notify mijo immediately of any unauthorized access or breach.

1.3 Account Maintenance

mijo reserves the right to request proof of identification and other relevant documents to verify your eligibility and compliance with the terms. Your account may be suspended or terminated if you provide false information or violate these Terms.

1.4 Service Provider Categories

Service providers can be blue-collar or white-collar workers. Examples of blue-collar services include plumbing, electrical work, cleaning, and repair services. White-collar services include consultancy, legal, financial, or other professional services.

  1. USING THE MIJO APP

2.1 Facilitation of Services 

mijo operates as an information society service through the mijo app, connecting service providers with individuals seeking services (“Customers”). mijo does not directly offer or control the services provided; the service provider delivers services independently under a contract formed between you and the customer.

2.2 Contractual Agreement with Customers

By accepting a service request through the mijo app, you enter into a direct contractual relationship with the customer. You are solely responsible for the execution, quality, and delivery of the services agreed upon. mijo assumes no responsibility for the execution of the contract between you and the customer.

2.3 Pricing of Services

You are responsible for setting the price of the services you offer. The price must be agreed upon between you and the customer before the service is rendered. Payment can be made in cash, mobile money, or any other mutually agreed method of exchange. You are however required to indicate the agreed figure to be paid by the customer for the service to be rendered and the relevant terms of the agreement into the mijo app. mijo is not responsible for payment disputes between you and the customer.

2.4 Service Quality and Professional Conduct 

As a service provider, you must adhere to high standards of professionalism, integrity, and service quality. mijo reserves the right to suspend or terminate your account if you receive multiple complaints about poor service quality or unprofessional conduct.

  1. CANCELLATION OF SERVICES

3.1 Customer Cancellations

If a customer cancels a service request after it has been accepted by you, you may charge a cancellation fee, subject to the terms agreed upon with the customer. The amount of this fee must be disclosed upfront on the mijo platform.

3.2 Provider Cancellations

You have the right to cancel a service request before it commences, provided that valid reasons are given, and the customer is notified in a timely manner. However, frequent cancellations without reasonable cause may result in account suspension. Any costs to the customer arising from your cancellation must be born by you

  1. LIABILITY AND LIMITATION OF RESPONSIBILITY

4.1 Liability for Services Rendered

As a service provider, you are solely liable for the quality and results of the services you deliver to the customer. mijo is not responsible for any damages, losses, or claims that arise from your services, including but not limited to personal injury, property damage, or breach of contract.

4.2 Indemnity 

You agree to indemnify and hold mijo, its affiliates, employees, and agents harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your services, breach of these Terms, or violation of any law or regulation.

4.3 Limitation of Mmijo’s Liability

mijo provides the app on an “as is” and “as available” basis. mijo does not guarantee uninterrupted or error-free access to the platform and is not responsible for any disruptions, technical issues, or third-party actions that may affect service delivery.

4.4 Insurance

mijo encourages service providers to carry appropriate insurance for their services (e.g., liability insurance) to cover any potential risks or damages that may arise during the course of service delivery.

  1. PAYMENT TERMS

5.1 Payment Collection 

Service providers are responsible for collecting payment directly from customers, using any of the payment methods agreed upon through the. Mmijo does not manage or control the transfer of funds between service providers and customers.

5.2 Monthly Subscription Fees 

mijo reserves the right to charge service providers a monthly subscription fee. The amount and terms of such fees will be communicated to you before you signup.

  1. TERMINATION AND SUSPENSION OF ACCOUNT

6.1 Account Suspension 

mijo reserves the right to suspend or terminate your account at any time, without prior notice, if you are found to be in violation of these Terms or if we deem your continued use of the platform harmful to our customers, other service providers, or mijo’s reputation.

6.2 Voluntary Termination

You may terminate your account with mijo at any time by providing written notice to mijo. Upon termination, you will cease all use of the mijo app, and any pending obligations to customers or mijo (such as payments or pending services) must be resolved.

  1. USER RATINGS AND FEEDBACK

7.1 Customer Feedback

Customers may leave ratings and feedback regarding the services you provide. mijo reserves the right to display this feedback on the platform and use it for internal quality control. Repeated negative feedback may result in account suspension or termination. Two and one star ratings are considered negative feedback. Such shall be investigated.

7.2 Responding to Feedback

You may have the opportunity to respond to customer feedback directly within the mijo app. However, any attempts to manipulate, incentivize, or coerce customers into providing favorable feedback may result in account termination.

  1. BEST PRACTICES AND CODE OF CONDUCT

8.1 Professional Behavior

As a service provider, you are expected to maintain a professional demeanor at all times when interacting with customers. This includes being punctual, respectful, and delivering the agreed-upon service to the customer’s satisfaction.

8.2 Compliance with Laws and Regulations 

You must comply with all applicable laws, regulations, and licensing requirements governing your service area or profession. Failure to do so may result in account termination.

  1. MODIFICATION OF TERMS AND CONDITIONS

9.1 Changes to Terms

mijo reserves the right to modify or update these Terms at any time. You will be notified of any significant changes through email or notifications within the mijo app. Continued use of the platform after such changes constitutes acceptance of the revised Terms.

  1. FINAL PROVISIONS

10.1 Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms or your use of the mijo app shall be subject to the exclusive jurisdiction of the courts of Ghana.

10.2 Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be replaced with a valid one that closely reflects the original intent.
