TERMS AND CONDITIONS FOR INDIVIDUALS SEEKING SERVICES (CUSTOMERS)

 

  1. Purpose and Scope:
    1. The Mmijo app serves as a platform connecting service providers (such as professionals, vendors, or contractors) with individuals seeking their services.
    2. The app operates within specific geographical areas.
  2. Definitions:
    1. “Us” or “we” refers to Mmijo, a private limited company registered in Ghana.
    2. “Customer” denotes the individual using the app to find services.
  3. Consent and Acceptance:
    1. By accessing and using the Mmijo app, you implicitly agree to these terms and conditions.
    2. It’s essential to review and understand them before using the app.
  4. Service Provider Interaction:
    1. The app facilitates communication between customers and service providers.
    2. Customers can request services, view profiles of providers, and make bookings.
  5. Service Quality and Liability:
    1. Mmijo strives to maintain service quality but does not guarantee it.
    2. Service providers are responsible for their performance.
    3. Mmijo is not liable for any direct or indirect damages resulting from service provision.
  6. Privacy and Data:
    1. The app collects and processes personal data. Customers should review the privacy policy.
    2. Customers consent to the use of their data for app functionality.
  7. Fees and Payments:
    1. The app may charge fees for certain services.
    2. Payment terms and methods are specified within the app.
  8. Termination and Suspension:
  9. a) Mmijo reserves the right to terminate or suspend accounts for violations or other reasons.
  10. Intellectual Property:
  11. a) The app’s content and intellectual property belong to Mmijo.
  12. Updates and Modifications:
  13. a) Mmijo may update or modify the app and its terms. Users will be notified.
  14. Mmijo’s Role:
    1. Mmijo acts as an intermediary, connecting service providers with individuals seeking services.
    2. Service providers operate independently and are responsible for delivering the services.

 

  1. Contractual Agreement:
    1. When you (as an individual seeking services) use the Mmijo app, you enter into a contract with the service provider.
    2. Any disputes related to service quality, consumer rights, or legal obligations should be resolved directly between you and the service provider.
  2. Service Cost and Payment:
    1. You negotiate the service cost directly with the service provider.
    2. The agreed-upon amount should be entered into the app as consideration for the upcoming service.
    3. Payment options include cash or Mmijo’s in-App Payment.
    4. Remember that applicable taxes are included in the charges.
  3. Tipping Option:
  4. a) You can choose to provide a tip to the service provider, either directly or through Mmijo’s inApp Payment
  5. Mobile Number Association and Anonymization:
    1. When you install the Mmijo app, your mobile number becomes associated with your Mmijo user account.
    2. If you decide to discontinue using your mobile number, it’s essential to notify Mmijo within a 7day period.
    3. This notification allows Mmijo to anonymize your account data.
    4. Failure to communicate changes in your number could result in your mobile operator reallocating the same number to a new user.
    5. In such cases, the new user might potentially access your data.
  6. In-App Payment Options:

Depending on the payment options agreed upon with the service provider, you have flexibility in how you pay for services:

  1. Cash: You can pay the service provider directly in cash.
  2. Mobile Money: Mmijo offers an in-App Payment system that allows you to pay using mobile money.
  3. Other Designated Methods: If there are other specified payment methods, you can use those as well.
  4. Mmijo acts as a commercial agent for service providers in this process.
  1. Payment Fulfillment:
    1. When you initiate a payment order to transfer funds to Mmijo’s designated bank account, your obligation to the service provider is considered fulfilled.
    2. As the recipient of the service, it’s your responsibility to ensure the payment is executed successfully and that sufficient funds are available.

 

  1. Payment Processing:
    1. When you use Mmijo in-App Payment for transactions, Mmijo acts as an intermediary.
    2. Mmijo receives your payments and facilitates the transfer of funds to the service provider.
    3. To ensure security and accuracy, Mmijo may request additional information from you to verify the payment method.
  2. Third-Party Payment Costs:
    1. While Mmijo handles the payment process, it’s essential to note that external service providers (such as mobile operators or banks) may impose additional fees during payment processing.
    2. Mmijo explicitly disclaims any liability for these third-party fees.
    3. Additionally, your chosen payment method may have its own terms and conditions set by the relevant third-party payment service provider.
    4. I recommend reviewing these conditions before utilizing your preferred payment method.
  3. Mmijo’s Responsibility and Support:
    1. Mmijo takes responsibility for the functionality of its in-App Payment system.
    2. If you encounter any issues related to payments, Mmijo offers support for resolution.
    3. For payment-related inquiries, you can contact Mmijo at info@mmijoafrica.com.
    4. Queries submitted via email or the Mmijo App will receive a response within one business day.
    5. Mmijo is committed to addressing and resolving in-App Payment-related complaints and applications within two business days.
  4. Ordering Transportation Services:
    1. When you request a transport service, and the driver agrees to take on the assignment, the transportation service is considered ordered.
    2. This initial agreement forms the basis for the service.
  5. Separate Agreement with the Driver:
    1. Upon the driver’s confirmation of accepting your journey, a separate agreement is established between you and the driver.
    2. This agreement outlines the specific terms and conditions that both parties agree upon.
    3. Importantly, Mmijo is not directly involved in this arrangement; it’s between you and the driver.
  6. Cancelling Ordered Services:
    1. If you reject, cancel, or refuse a transport service after the driver has responded to your request, it’s considered a cancellation.
    2. Be aware that there may be a cancellation fee if the request is cancelled after a specified time period.
  7. Account Warnings and Suspension:
    1. Repeatedly cancelling transport service requests within a 24-hour period may lead to temporary account blocks as a warning.
    2. Following multiple warnings, your account could be suspended for a more extended period (e.g., 6 months).
    3. After the suspension period, you can request reactivation, subject to Mmijo’s review.
  8. Driver’s Arrival and Passenger Responsibility:
    1. If the driver notifies you about their arrival at the destination, it’s crucial to reach the vehicle promptly.
    2. Failure to do so may result in the request being deemed cancelled.
    3. Note that Mmijo is not liable for such situations; it’s between you and the driver.
  9. Additional Fees for Delays:
  10. a) Upon the driver’s arrival and notification to you, any delays may lead the driver to charge an extra fee for the extended waiting time.
  11. Damage to the Driver’s Vehicle:
    1. If you cause damage to the driver’s vehicle or its interior (such as blemishes, stains, or unpleasant odours), the driver has the right to demand a penalty of GH¢200.
    2. Beyond the penalty, the driver may seek compensation for damages.
    3. Failure to pay the penalty or compensate for damages could result in Mmijo pursuing these claims on behalf of the transport service provider.

 

Terms And Conditions: Ordering And Cancelling Skilled/Professional Services

 

Service Ordering

  1. Agreement Formation
    1. When a customer (referred to as “you”) requests skilled or professional services through our platform (the “Service”), an agreement is formed between you and the service provider.
    2. The service provider, upon accepting the assignment, agrees to deliver the requested service based on the terms outlined in this agreement.
  2. Service Details
    1. The specifics of the service (scope, duration, cost, etc.) are agreed upon between you and the service provider.
    2. Any additional terms or requirements should be communicated clearly during the ordering process.
  3. Service Provider Autonomy
    1. Service providers operate as autonomous entities, responsible for their performance and adherence to professional standards.
    2. Our platform facilitates connections but does not directly provide the services.

 

Service Cancellation

  1. Customer-Initiated Cancellations

If you need to cancel a requested service:

  1. Notify the service provider promptly.
  2. Be aware that cancellation fees may apply if the cancellation occurs after a specified time (as agreed upon during ordering).
  1. Repeated Cancellations

Multiple consecutive cancellations within a defined period may result in: a)           Temporary account warnings.

  1. Subsequent account suspension (e.g., for six months).
  2. Account reactivation is possible after the suspension period, subject to review.

 

Terms And Conditions: Mmijo App Usage

 

  1. Permission to Utilize Mmijo App
    • License Grant
      1. Subject to your compliance with the stipulations outlined in these General Terms and Conditions, we grant you a revocable, non-exclusive, royalty-free right to access and utilize the Mmijo app.
      2. This permission is governed by these terms, the Privacy Notice, and any relevant terms set forth by the app store.
      3. Transferring or sublicensing your right to use the Mmijo app is strictly prohibited.
      4. If your authorization to use the app is revoked, the corresponding non-exclusive license will also be rescinded.
  1. Responsibility and Limitation of Liability
    • Quality and Availability
      1. The Mmijo app serves as an information society service connecting individuals seeking services with service providers.
      2. We do not guarantee the quality of services or absence of defects.
      3. Continuous availability of service offers relies on the behaviour of service providers.
  1. Platform Role
    1. Mmijo app does not act as an intermediary or agent for customers or service providers.
    2. It functions solely as a platform for organizing service provision.
  2. Refunds
    1. The consumer’s right of refund does not apply to Mmijo app orders.
    2. Seeking a refund from the service provider does not annul the agreement under which the service was ordered.
  3. App Functionality
    1. The Mmijo app is provided “as is” and “as available.”
    2. While we promptly address software faults, occasional technical errors may restrict functionality, especially during public emergencies.
  4. Liability Disclaimer
    1. Mmijo, its representatives, directors, and employees are not liable for losses or damages resulting from app usage.
    2. This includes direct or indirect property damage, monetary loss, loss of profit, business interruption, data inaccuracies, and other forms of loss or damage.
  5. Financial Liability
    1. Mmijo’s financial liability for contract breaches is limited to GH¢500.
    2. Claims for damages are valid only in cases of deliberate contract violation.
    3. Mmijo is not responsible for service providers’ actions or any damages they may cause to customers.
  6. Indemnification
  7. a) Users agree to indemnify and hold Mmijo, its affiliates, representatives, employees, and directors harmless from claims arising from app usage, including services obtained through the app.
  8. Account Termination
  9. a) Mmijo reserves the right to immediately terminate user access if a breach of these General Terms and Conditions occurs or if necessary to safeguard Mmijo’s integrity or service provider safety.

 

  1. Best Practices for Mmijo App Usage
    • Service Issues
      1. As Mmijo does not directly provide services, any issues related to defects or quality will be addressed according to service provider rules or by relevant authorities or courts in Ghana.
      2. We encourage users to provide feedback within the app to enhance service quality.
  1. Respectful Usage
    1. Users should utilize the Mmijo app in good faith and show respect to service providers.
    2. Account termination may occur without prior notice for terms violations or malicious activities. Service Provider Integrity and Reporting

44.1     Service Provider Selection:

  1. Mmijo strives to onboard service providers who uphold integrity and respect for their profession and customers.
  2. However, it’s important to acknowledge that not every service provider identified by the Mmijo app consistently meets these criteria.
  3. Users should approach service interactions with awareness and reasonable expectations.
  1. Encountering Unsatisfactory Service:

If you, as a user, encounter unsatisfactory service: Report the issue promptly. Consider the following steps:

  1. Contact the Service Company: Reach out to the responsible service company directly. They may address the issue promptly.
  2. Supervisory Authority: If necessary, escalate the matter to relevant supervisory authorities or regulatory bodies.
  3. Customer Support: Contact Mmijo’s customer support. We’re here to assist and address any concerns.
  1. Continuous Improvement:
    1. Mmijo values user feedback. It helps us improve our platform and enhance the overall experience.
    2. By reporting issues, you contribute to maintaining service quality and holding providers accountable.
  2. Amendments to General Terms and Conditions

47.1 Notification of Significant Changes

  1. If there are significant amendments to the General Terms and Conditions, you will receive notifications via email or Mmijo app notifications.
  2. By continuing to use the Mmijo app after receiving these notifications, you will be considered to have accepted the proposed amendments.
  1. Final Provisions
  2. a) Governing Law:
  3. The General Terms and Conditions shall be governed, interpreted, and enforced in accordance with the laws of the Republic of Ghana.
  4. b) Dispute Resolution:

If disputes arising from the General Terms or Agreement cannot be resolved through negotiation:

  1. The resolution process will be pursued in the courts of Ghana.
  2. c) Severability: 

In the event that any provision of the General Terms is deemed unenforceable:

  1. The parties will replace the affected provision with an enforceable one that closely aligns with the original intent and economic impact.
  2. d) Effective Date:
  3. These terms come into force on February 19, 2024.
